A state appeals court has revived a suit filed by a plaintiff against their former counsel after finding that a trial court improperly granted a motion to dismiss after co-counsel had already been disqualified.

The Georgia Court of Appeals issued an opinion Sep. 23 remanding the dismissal of a legal malpractice case in which an attorney was accused of incompetently representing his client in a prior medical-malpractice suit. Plaintiff Frances McQueen alleged that Atlanta attorney Clarence V. Long failed to provide expert affidavits in the case, causing it to be dismissed.
