Atlanta’s federal appeals court has ruled that the winter storm that paralyzed the city in January 2011 is no excuse for a filing that arrived at the courthouse one day late.

Tuesday’s ruling by a three-judge panel of the U.S. Court of Appeals for the Eleventh Circuit said the untimely filing means the court is without jurisdiction to hear the appeal of Chao Lin and his wife, Xue Yun Lin, Chinese citizens who sought asylum based on having violated China’s birth-limitation policy. The panel of Judges Gerald Tjoflat and William Pryor and Senior Judge Peter Fay refused to hear the Lins’ plea that their case be re-opened.
