A class action against Blue Cross Blue Shield of Michigan over the company’s denial of a particular therapy for autism can move ahead, the U.S. Court of Appeals for the 6th Circuit has ruled.
On Feb. 24, a unanimous panel in In re Blue Cross Blue Shield issued a two-page opinion denying Blue Cross’ petition to appeal a class action certification order. Eastern District of Michigan Judge Stephen J. Murphy III issued the order certifying the case as a class action in July 2011.
