A federal appeals court has reinstated a religious discrimination lawsuit brought by a counseling degree graduate student expelled by Eastern Michigan University faculty because she asked to refer a gay client to another grad student.

On Jan. 27, a unanimous panel of the 6th U.S. Circuit Court of Appeals reversed a summary judgment ruling in favor of the university defendants issued by Judge George Steeh of the Eastern District of Michigan in July 2010. The panel also remanded the case, Ward v. Polite, to the lower court for further proceedings.
