The 7th U.S. Circuit Court of Appeals has denied a mandamus petition brought by FedEx against the U.S. Judicial Panel on Multidistrict Litigation. At issue was the panel’s remand to their original courts of a dozen cases brought by FedEx drivers seeking to be classified as employees.
On Nov. 17, a unanimous panel in FedEx Ground Package System Inc. v. U.S. Judicial Panel on Multidistrict Litigation denied FedEx’s “extraordinary writ of mandamus” seeking to overturn the judicial panel’s decision to remand the cases.
