A long-running medical malpractice dispute seemed to end last year when the case settled after the trial judge tossed a defendant’s pleadings to punish his lawyer for conducting a 15-minute conversation with one of the plaintiffs’ doctors, without the permission of the plaintiffs’ counsel.

But a lawyer for the plaintiffs, a woman and daughter who claimed injury from a premature delivery, has now sued the participants in that discussion, which took place moments before the doctor’s deposition.
