An environmental group’s efforts to have the state Environmental Protection Division rescind a permit it granted to a Sea Island homeowner has turned into a dispute over whether an organization forfeits its right to keep the identities of its members confidential once it commences litigation.
Attorneys for the St. Simons-based Center for a Sustainable Coast say their client’s First Amendment right to free association was violated by an administrative law judge’s order to produce its membership rolls in response to a subpoena. When the center’s representatives and lawyers showed up for a hearing without the rolls, the ALJ dismissed their petition challenging the permit.
