A debate about whether the 2008 firing of broadcaster Barry Nolan for protesting a television group’s plans to honor Bill O’Reilly was a contractual or free speech issue dominated oral arguments at the 1st U.S. Circuit Court of Appeals.

The May 4 oral argument in Nolan v. CN8 bounced back and forth between those two theories of the case.
