One of Judge Gail C. Flake’s colleagues on the DeKalb Superior Court bench has ordered that Flake be recused from a contentious case over a valuable estate.

Flake, despite two requests from counsel, had refused to disqualify herself from hearing the case, even though one of the lawyers before her on the civil estate case, J. Tom Morgan, had, in his prior job as the DeKalb district attorney, prosecuted Flake’s then-husband, former DeKalb Sheriff Pat Jarvis. Jarvis pled guilty to felony-level corruption in 1999. The corruption case is unrelated to the estate case.
