Much of the recent action in cigarette product liability litigation has been down in Florida, where tobacco companies have been slugging it out with individual plaintiffs in the wake of the Florida Supreme Court’s Engle decision.
But as we’ve reported, Philip Morris has also been fending off claims in federal multidistrict litigation in Maine over the company’s sale of light cigarettes, which plaintiffs contend were marketed deceptively as a healthier alternative to regular smokes. Last week, Phillip Morris and its lawyers at Arnold & Porter and Skadden, Arps, Slate, Meagher & Flom won a ruling denying class certification for plaintiffs in four key cases in the MDL.
