A bankruptcy judge on Tuesday rejected a move by lawyers for Ameris Bank to dismiss a bankruptcy petition so the bank could execute an immediate foreclosure sale of commercial property owned by the petitioner.

The bank even had someone waiting on the Fulton County Courthouse steps to cry the sale of the 1/4-acre tract, located at Ivan Allen Jr. Boulevard and Luckie Street, which had been slated for development as Aquarius Tower, an energy independent 38-story condominium.
