A trade dress suit filed by the Atlanta-based maker of Dixie Cups against the maker of Chinet over the design of an insulated paper cup has been thrown out by a federal judge.
In October 2008, Dixie Consumer Products sued Kansas-based Huhtamaki Americas Inc. Dixie claimed that Huhtamaki’s design for its Comfort Cup-which features a narrow white band at the base where an insulating strip of paper is cut off-violated Dixie’s design for its Insulair Cup, which also features such a strip.
