Lawyers for once-accused “dirty bomber” Jose Padilla on Tuesday asked federal appeals judges in Atlanta to toss his terror support convictions while prosecutors argued that Padilla should have been sentenced to something harsher than 17 years in prison.
Lawyers for Padilla and his co-defendants Adham Hassoun and Kifah Jayyousi argued that the men should get a new trial because, among other mistakes, the Miami trial judge should not have allowed an FBI agent inexperienced in terror cases and the Arabic language to testify about the meaning of alleged code words used in intercepted calls. At issue were rules of evidence requiring a witness who is not an expert to testify only about his firsthand observations.
