The Georgia Supreme Court has upheld a lower court decision that said a DeKalb County judge may have needed to recuse from a case in which one of the lawyers successfully prosecuted her then-husband.
In a decision that made new law on appellate procedure, Justice David E. Nahmias on Friday wrote for a unanimous high court that the Court of Appeals properly handled a case involving an inheritance battle over the proceeds of the sale of a Druid Hills home worth nearly a million dollars.
