A potentially massive antitrust class action got closer to trial this week, as a federal trial judge in Atlanta rejected a major insulation contractor’s attempts to pause for more discovery and an appeal.

A group of insulation contractors have alleged that one of their competitors, Michigan-based Masco Corp., conspired with insulation manufacturers to fix insulation prices in the industry. U.S. District Chief Judge Julie E. Carnes had rejected Masco’s request that she dispose of the case on summary judgment, and on Monday the judge issued an order calling “patently frivolous” Masco’s request that she allow it to appeal her summary judgment ruling to the 11th U.S. Circuit Court of Appeals before a trial. She also denied Masco’s motion for an extension of discovery, saying the time for seeking the information Masco wants has long passed.
