A hearing in Bartow County Superior Court today will determine whether an assistant district attorney has a conflict of interest in serving as an elected city council member.
The question comes before Judge G. Carey Nelson III in the form of an appeal by Wesley A. “Wes” Godwin, a real estate developer who is running for the 4th ward seat on the Marietta City Council now held by Cobb County Chief Deputy Assistant District Attorney Irvan Alan “Van” Pearlberg. Pearlberg, who has been an assistant district attorney since 1990, was elected to the city council in 2005 and is running for re-election.
