Georgia Supreme Court Chief Justice Leah Ward Sears told legislators Tuesday afternoon that the Senate’s budget proposal for the judicial branch is unconstitutional.

In a hand-delivered letter to House and Senate budget conferees, Sears said the Senate’s budget for the upcoming fiscal year “micro manages the affairs of the judicial branch … and is, therefore, inconsistent with the constitutional doctrine of separation of powers.” Sears wrote on behalf of the Judicial Council of Georgia, which she chairs.
