Less than a year ago, the Alaskan village of Kivalina filed suit in a federal court in California, seeking damages because the residents claim they are being forced to relocate because of flooding allegedly caused by climate change.

Similar nuisance cases have been dismissed by the courts, including one seeking damages arising from Hurricane Katrina. One case is Comer v. Murphy Oil USA, 1:05-CV-436-LG-RHW S.D. Miss..
