Another opening has surfaced on the federal appeals court based in Atlanta, although it will be summer 2010 before President Barack Obama can place his choice on the bench.
In a recent interview, Judge Stanley F. Birch Jr. of the 11th U.S. Circuit Court of Appeals said he plans to take senior status shortly after he becomes eligible upon his 65th birthday in late August 2010. He said he plans to write the president this August to give him formal notice.
