Residents in the posh Country Club of the South development have triumphed in their legal battle against their own homeowners association over a plan that would have forced them to join the golf and tennis club from which the community draws its name-and, in the process, help cover millions of dollars in debt the club has run up as it underwent renovations in recent years.

In a settlement agreement signed by Fulton County Superior Court Judge Thelma Wyatt Cummings Moore on Dec. 10, the two parties agreed that two-thirds of the development’s homeowners would need to approve the move, but according to a lawyer for the homeowners protesting the merger, the vote had already been taken.
