A decision by Fulton County Superior Court Judge Jerry W. Baxter to set aside a jury’s conviction of a Midtown man of felony murder and aggravated assault continues to resonate in the courthouse.

Fulton District Attorney Paul L. Howard Jr. this week filed a notice of appeal in his quest to have the defendant, Craig S. Tomko, sent to prison for much longer than the five years he faces because Baxter eliminated the two most serious charges against him. The judge did not disturb Tomko’s conviction of involuntary manslaughter.
