Health care businesses are subject to painful amounts of regulation at the federal, state and local levels. Arrangements, such as joint ventures, partnerships, consulting contracts and finders’ fee arrangements, that may be perfectly acceptable in other industries, can be subject to criminal prohibitions in the health care arena. In some cases, business arrangements in the health care industry can lead to criminal prosecutions and jail time for the participants. Health care businesses are well advised to keep a close eye on government enforcement priorities-particularly at the federal level-because a large majority of health care services are funded under the federally sponsored Medicare and Medicaid programs.
