A FEDERAL JUDGE in Atlanta will allow a jury to hear damage claims against Southern Co. leveled by a firm representing unsecured creditors of Mirant-an energy marketer and former Southern subsidiary that emerged from bankruptcy last January.
U.S. District Judge Beverly B. Martin on Monday cleared for trial the suit brought by MC Asset Recovery against the Atlanta-based power conglomerate. MC Asset Recovery represents both Mirant and its unsecured creditors.
