Contractor Heery International claims that DeKalb County school officials destroyed incriminating emails, but lawyers for the school district say Heery is just upset that it hasn’t found the evidence it sought to win the highly charged litigation between the parties.
Heery asked that a judge punish the DeKalb school district for evidence spoliation by dismissing its $120 million claim that Heery overbilled and mismanaged school renovation and building projects from 1997 to 2006. The matter is set to be heard Oct. 2 by JAMS neutral Stanley Birch Jr., a former judge on the U.S. Court of Appeals for the Eleventh Circuit who is acting as a special master in the school litigation.
