The Georgia Supreme Court on Monday revived a $459 million verdict over the sending of so-called junk faxes, while leaving open the door for the verdict to be upended yet again.

The 2010 verdict was issued by a Fulton County judge against a now-defunct Alpharetta-based home improvement company, American Home Services, for sending unsolicited advertisement faxes. Last year a state Court of Appeals panel vacated the verdict, saying the trial judge erroneously based the award on a finding that the defendant had sent 306,000 unsolicited faxes without requiring the plaintiffs to prove the faxes had been received.
