The Court of Appeals of Georgia has upheld the dismissal of a medical malpractice suit over the death of a 10-month-old boy, saying the physician who verified the plaintiffs’ complaint did not have enough experience in the area of medicine at issue to be considered an expert.
The ruling was a win for the doctor who treated Jonathan Bermudez-Aguilar at Children’s at Scottish Rite. Both he and the hospital were accused of intubating the boy incorrectly, causing a lung to collapse, and of failing to diagnose and treat inflammation of his heart.
