The Supreme Court of Georgia has decided not to hear an appeal of an unusual mistrial in a medical malpractice case about a baby who suffered catastrophic brain damage at birth.
The court denied WellStar Health System Inc.’s writ of certiorari April 29. The Georgia Court of Appeals denied WellStar’s appeal in November 2012, saying the hospital couldn’t challenge the mistrial because its lawyers hadn’t objected to it at the time it occurred.
