An appeals court panel has upheld the dismissal of a long-running malpractice suit against Atlanta law firm Smith, Gambrell & Russell on the ground that the case lay dormant in Fulton County State Court for more than five years.

A Georgia statute says civil cases must be dismissed if a trial court enters no written order for five years. The rule is supposed to prevent cluttered dockets and protect litigants from lawyers who drag their feet.
