A judge has rejected most of a suit over the city of Roswell’s efforts to privatize its municipal court system and move from electing to appointing the chief judge of that court, a position that has been vacant since last August.

But Fulton County Superior Court Judge Constance Russell agreed with the plaintiffs—the now-fired clerk and deputy clerk of the Municipal Court—that the city had violated its charter by scheduling an election to fill the post 10 months after former Chief Judge Maurice Hilliard abruptly stepped down after more than 30 years on the bench.
