The Georgia Supreme Court has decided to take up a lawsuit over a shooting by an off-duty police officer that divided the state Court of Appeals.
The suit seeks to hold the owner of the City Views apartments and the complex’s management company responsible for the non-fatal shooting that took place at the apartment complex. By a 5-2 vote, the Court of Appeals last year said the companies that owned and managed the complex could be vicariously liable for the actions of the off-duty City of Atlanta police officer, Reginald Fisher. He had been providing security when he shot the plaintiff, Tramaine Miller, who was sitting in his car. Fisher said he thought Miller was reaching for a weapon, but it turned out Miller was unarmed.
