A Fulton County judge has ordered defendants who were hit with a $3 million jury award following a medical malpractice trial last year to pony up almost $1.5 million more in attorney fees, expenses and interest.

In an order issued Tuesday, State Court Judge Susan Edlein agreed with the plaintiff that a 2012 offer to settle the case for $2 million that was declined by the defense triggered Georgia’s offer of judgment statute, overriding defense claims that the decision of the plaintiff’s parents to drop their claims prior to trial “substantially altered” the case long after the settlement offer was made.
