The DeKalb County Superior Court judge presiding over this week’s motions hearing in the criminal case of suspended county CEO Burrell Ellis has denied Ellis’ motion to disqualify the district attorney from prosecution.
Judge Courtney Johnson’s order Tuesday also granted the state’s motion to dismiss Ellis’ motion to toss his 14-count indictment. She wrote that Ellis “has failed to show any intentional and purposeful discrimination that is based on an unjustifiable standard” and “has failed to show either a conflict of interest or any forensic misconduct as defined by Georgia law.”
