A plaintiff in a wrongful death case has won reinstatement of a $3 million verdict against a hospital—but her lawyer nonetheless is bothered by the part of the opinion by the Georgia Court of Appeals that lets a physician off the hook.
“The opinion is concerning because it indicates that a doctor can prescribe a medication that may hasten death and does not have to tell the patient that,” said Laura Shamp, an Atlanta lawyer who represents the daughter of Janie Vinson, who died at Phoebe Putney Memorial Hospital in 2002 at the age of 79.
