The Georgia Supreme Court has agreed to consider whether a plaintiff who brings a malpractice case has only one shot to get right the expert affidavit the law requires be filed with the complaint.
The court on Monday granted a defense petition for certiorari in a medical malpractice case decided by the Georgia Court of Appeals in February. The court has agreed to review the panel’s decision that when a plaintiff files his complaint with an affidavit by a person who isn’t qualified to testify as an expert in the action, the plaintiff may cure this defect by filing an amended complaint with an affidavit by a competent expert.
