The defense prevailed in a nearly two-week-long Cherokee County State Court product liability trial over the cause of the death of an infant in a van modified for wheelchair access.
One-year-old Robbert Culbertson Jr., known to his family as Robbie, was killed on Jan. 7, 2008, when his family’s modified Toyota Sienna minivan was hit from behind on Canton Road near I-75 in Cobb County, according to summaries from both sides in the consolidated pre-trial order. His parents, Robbert and Kathleen Culbertson, had purchased the used van to accommodate the needs of Robbie’s disabled grandmother. In the crash, the front passenger seat came loose, throwing the mother back into the infant car seat two rows behind her. The middle seats had been removed to accommodate the grandmother’s wheelchair, which was not with them on this trip.
