An Atlanta-based federal appeals court panel has rejected a laboratory testing company’s challenge to expert testimony against it in a case alleging technicians missed a patient’s cervical cancer.

The case decided by the U.S. Court of Appeals for the Eleventh Circuit on July 29 is one of several against Laboratory Corporation of America over alleged misreadings of Papanicolaou (“Pap”) smear test slides. The Georgia Court of Appeals in March ruled for the plaintiff in a wrongful death case involving the same plaintiff’s expert, Dorothy Rosenthal, a pathologist and professor at The Johns Hopkins University in Baltimore.
