Georgia’s highest court is being called on to consider the extent to which a man who witnessed his friend’s death in an auto accident can recover for his emotional suffering.
Lawyers for a defendant trucking company have asked the state Supreme Court to look at a particularly gory case that fractured the state Court of Appeals. At issue is whether the plaintiff can recover for emotional pain suffered as a result of not only his own physical injuries in the accident, but also from being splattered with his friend’s blood and tissue.
