Lawyers behind Attorney General Sam Olens are defending their decision not to turn over a key memo in a whistleblower case, despite a judge’s fining the Law Department $10,000 for the failure.

Chief Deputy Attorney General Jeff Milsteen and Solicitor-General Nels Peterson said Thursday they stand by a senior assistant AG’s determination that the memo, which alleged the governor’s top aides were interfering in an ethics investigation, was not responsive to requests for documents in the lawsuit. The request was made by a lawyer for the former head of the ethics commission, who claimed she was forced out because of her investigation into the governor’s campaign finances.
