The Georgia Court of Appeals has thrown out claims by former New York Giant Deon Grant, who had accused the condominium association at the upscale Phoenix on Peachtree of unfairly punishing him for having reflective tinted windows on his 22nd floor unit.
A lower court had dismissed Grant’s claim that the condo association’s actions were racially motivated and in violation of Georgia housing law but left alive claims that the association had breached its bylaws and fiduciary duty to the former NFL star.
