In recent weeks, several online retailers, including eBay, Amazon.com and Etsy, have removed Confederate flags from their stores. Some companies made the decision quietly. Others made public announcements. For example, eBay issued a statement that “We have decided to prohibit Confederate flags and many items containing this image because we believe it has become a contemporary symbol of divisiveness and racism.”
Similarly, last year, another high-profile decision was made by Etsy in response to the Trademark Trial and Appeal Board’s decision canceling several service mark registrations for the “Redskins” and “Washington Redskins” trademarks. In September 2014, Etsy issued a policy statement in which it announced that the word “redskin” would no longer be permitted in the Etsy marketplace. Etsy’s policy update stated “today we seek to balance two principles that are critically important to us: freedom of speech and protection from discrimination.”
