A federal judge has narrowed the scope of his order that declared Georgia’s garnishment law is unconstitutional.
Granting a motion to amend filed by a Gwinnett County court clerk who is the defendant in the case, Senior U.S. District Court Judge Marvin Shoob issued an order on Monday saying that his Sept. 8 ruling does not apply to continuing wage garnishments filed against a debtor’s employer. The judge on Monday modified his injunction to clarify that he was enjoining the Gwinnett clerk only from issuing summons to garnish debtors’ bank accounts.
