A Gwinnett County jury awarded $3.7 million to a man who, after a car wreck, claimed to have developed debilitating lower back pain that ultimately required spinal surgery.

Plaintiff’s attorney Mark Issa said the defense turned down four time-limited demands for the at-fault driver’s insurance policy limits of $25,000. He added that last year the defense declined a $475,000 settlement offer under Georgia’s offer of judgment statute, under which a party that declines a settlement offer and then loses at trial by at least 25 percent more than the rejected offer may have to pay the other side’s attorney fees accrued from the date of the offer.
