The Supreme Court of Georgia has denied an emergency motion that would have barred Gov. Nathan Deal from swearing in his three appointees to the state Court of Appeals. The court unanimously denied attorney Wayne Kendall’s motion to delay the swearing-ins until the high court could hear his appeal of a Fulton County judge’s decision that the governor had constitutional authority to make the appointments.
Last month, Kendall sued to stop the appointments of Brian Rickman, Amanda Mercier and Nels Peterson to an expanded appellate court on behalf of three lawyers, a former Macon city commissioner and a Douglasville minister. Kendall argued that the governor has no constitutional authority to fill the vacancies, which he said should be filled by election instead.
