A Florida deputy’s decision to fatally shoot a man in the back who was on the ground and apparently not resisting arrest violated clearly established law, the federal appellate court in Atlanta ruled Tuesday.

The three-judge panel’s finding affirmed a ruling by a federal judge in Florida who had rejected Palm Beach County Deputy Michael Suszczynski’s claim that he was immune from liability because he believed his 2012 decision to shoot Victor Arango was legal.
