The Georgia Supreme Court voted 6-1 Tuesday to uphold the governor’s appointment of three new Court of Appeals judges who took office in January.
The challenge came from a citizens group that includes the head of the Georgia NAACP. Their attorney, Wayne Kendall, argued that the state constitution requires the judges be chosen by election, not appointment, because they filled newly created positions, not unexpired terms.
