E-discovery is one of the most rapidly evolving areas of civil litigation. This is largely attributable to two principal reasons. First, the amount of digital data created and stored is growing exponentially. Just as one example, consider 100 billion emails are sent daily, equating to $36.5 trillion emails per year. Second, digital data storage platforms are quickly changing, both in the data type and the storage mechanisms.

Increasing e-discovery costs amplifies the importance of these changes. Indeed, e-discovery on average accounts for more than 50 percent of discovery costs in complex civil cases. Corporate counsel are now proactively taking measures to reduce these costs, including by retaining outside counsel who are knowledgeable about e-discovery. With this in mind, below is a brief summary of five technology trends and their potential impact on e-discovery.
