A man convicted of molesting and raping his girlfriend’s 7-year-old daughter has won the right to a new trial because his defense attorney failed to object to the prosecutor’s pointing out, during closing arguments, that the defendant did not deny the charges when he was arrested.

The state Court of Appeals found that the man’s lawyer provided ineffective assistance by not objecting to the DeKalb County prosecutor’s statements.
