The U.S. Court of Appeals for the Eleventh Circuit has ruled that corrections officials can be sued for the death of a prisoner they placed in a cell with a known violent paranoid schizophrenic.
A three-judge panel Wednesday revived a lawsuit alleging violation of the Eighth Amendment protection against cruel and unusual punishment. Seventh Circuit Judge Kenneth Ripple, sitting by designation, wrote the opinion, with Chief Judge Ed Carnes and Judge Jill Pryor in agreement. They reversed U.S. District Judge Marc T. Treadwell’s dismissal of the lawsuit.
