A DeKalb County judge has tossed out a case in which the plaintiff was seeking to collect a more than $5.3 million excess judgment verdict from an insurer whose client caused a wreck resulting in multiple claims for a limited pool of coverage.
State Court Judge Michael Jacobs’ order dismissing the case said that a purported demand letter from two of the injured claimants “was not a clear demand, let alone a time-limited demand” that would leave the insurer liable for a bad faith claim because it did not timely respond.
