The Georgia Court of Appeals has thrown out a criminal contempt citation that would have sent state Sen. Curt Thompson, D-Tucker, to the Douglas County Jail for 10 days, writing that the lawyer-lawmaker was not given notice that he was facing a criminal charge and had not knowingly waived his right to counsel.

The judge who issued the order, Douglas County State Court Judge James Barker, ordered Thompson held in contempt after he determined that Thompson’s explanations for missing a bench trial in a civil case were not credible and that Thompson had deliberately deceived the court.
